Terms of Service
Last updated: October 19, 2026
1. Agreement
These Terms of Service ("Terms") govern your use of FlareSpark (the "Service"), which lets you create short links, generate QR codes, and host QR code images. By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. The Service
FlareSpark provides URL shortening, QR code generation, and hosting of generated QR code images, together with user accounts to manage them. The Service is provided free of charge and may change, add limits, or be discontinued at any time.
3. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract.
- You must provide a valid email address and keep your password secret. You are responsible for all activity on your account.
- You must choose a username when you sign up. It is shown to other people, so it may not impersonate someone else or be offensive, and we may change or remove usernames that break this rule.
- One person may not create accounts in bulk or by automated means.
- Tell us promptly if you believe your account has been compromised.
4. Acceptable use
You may not use the Service to create links or QR codes that point to, or to distribute, any of the following:
- Phishing, fraud, scams, or impersonation of any person or organization.
- Malware, exploits, drive-by downloads, or anything designed to damage or gain unauthorized access to systems or data.
- Spam or unsolicited bulk messages.
- Content that is illegal where you or the visitor are located, including child sexual abuse material, human trafficking, terrorism, or content that infringes others' intellectual property rights.
- Harassment, threats, doxxing, or hate directed at people or groups.
You also may not: chain other link shorteners or otherwise disguise a destination to evade review; probe, scan, or overload the Service; circumvent rate limits or other protections; or resell the Service without our written permission.
5. Adult content
Legal adult (NSFW) content is allowed only if you mark it. Every short link, link tree page, link tree button, and every QR code that opens a web address has an "18+" option. If what you link to is sexually explicit or otherwise meant for adults, you must turn it on. Visitors then see a warning page and must confirm they are 18 or older before they continue.
- We may mark your content as adult ourselves, and you can't remove a mark that we add.
- You may never link to or share sexual content involving minors, sexual content shared without the consent of the people in it, or anything else that is illegal.
- Pictures you upload to FlareSpark (profile pictures and page backgrounds) may not be sexually explicit, even on a page marked 18+.
- Adult content isn't allowed on things that can't show a warning, such as fixed QR codes for Wi-Fi, contacts or plain text.
6. Your links and QR codes
You are solely responsible for the destinations you link to and the content you encode. We do not review links in advance and do not endorse any destination. You keep ownership of your content. You grant us a limited license to store, process, and serve your links and QR codes as needed to operate the Service.
Short link slugs are licensed to you while your account is active. We own the domain and the Service, and we may reclaim or reassign slugs from deleted or terminated accounts. QR codes that point to a short link stop working when that link is deleted or disabled.
7. Reporting and enforcement
Anyone can report a short link at FlareSpark/report. We may, at our discretion and without prior notice, disable links, remove hosted QR codes, suspend or terminate accounts, and cooperate with law enforcement or legal process, particularly where we believe these Terms were violated or someone may be harmed.
8. Termination
You may delete your account at any time from your dashboard. Deleting your account deletes your links and QR codes, and any printed or shared QR codes or short links that depended on them will stop working. We may suspend or terminate your access at any time, with or without notice.
9. Availability and backups
We do not guarantee that the Service will be available, error-free, or that links and QR codes will remain available. Do not rely on the Service for anything safety-critical or irreplaceable, and keep your own record of your destinations.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FlareSpark AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnity
You agree to defend and indemnify FlareSpark and its operator against claims, losses, and expenses (including reasonable legal fees) arising from your links, your QR codes, your content, or your breach of these Terms.
13. Changes to these Terms
We may update these Terms from time to time. We will change the "Last updated" date above and, for material changes, make reasonable efforts to notify you. Continuing to use the Service after a change means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which the operator of FlareSpark is based, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction unless the law of your country of residence requires otherwise.
